JUSTICE SUDHIR SINGH ORAL ORDER 30-04-2015 The petitioner is apprehending his arrest in connection with Katihar Nagar P.S.Case No. 698 of 2014 instituted under Sections 341, 323, 324,307, 379 and 506/34 of the Indian Penal Code, pending in the court of learned C.J.M., Katihar. Heard learned counsel for the petitioner and the State. The prosecution case, in brief, is that the petitioner gave dagger blows on the person of the informant for snatching money and after giving dagger blows snatched Rs. 25,000/-. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in the present case due to land dispute between the parties.
On behalf of the State it is submitted that there is specific allegation against the petitioner causing injury to the informant
Patna High Court Cr.Misc. No.49734 of 2014 (2) dt.30-04-2015 2/2 and the same is corroborated by the injury report. Considering the aforesaid facts, I am not inclined to grant privilege of anticipatory bail to the petitioner. The prayer for anticipatory bail of the petitioner is rejected. However, if the petitioner surrenders before the court below within six weeks and pray for regular bail, the same shall be considered on its own merit without being prejudiced by this order of rejection, preferably on the same day.
