Mr. Choubey Jawahar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-04-2025 Heard learned counsel appearing on behalf of the petitioner and learned A.P.P. appearing on behalf of the State.

2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 341, 323, 379, 504 and 506 of the Indian Penal Code.

3. As per prosecution case, informant, namely Bipin Kumar Sharma, alleged that this petitioner had taken a sewing machine on credit from shop of informant and on 12.05.2022 and when informant went to house of this petitioner to demand payment, he was abused and assaulted by this petitioner. It is further alleged that this petitioner forcibly took Rs. 7,000/- cash from informant's pocket.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has

As a matter of fact, petitioner was working in the shop of informant as a laborer and there was dues of Rs. 12,000/- and when the petitioner demanded his money, this false and concocted case has been lodged. Injury, allegedly caused by the petitioner, has been opined to be simple in nature. It is further submitted that during pendency of the present case, the dispute between the parties has already been settled and a joint compromise petition to that effect, duly signed by both the parties, has also been filed, copy of which is Annexure-P/3 to this bail petition.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

6. Considering the nature of accusation and compromise between the parties, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M., Darbhanga in connection with Bishanpur P.S. Case No. 59 of 2022, subject to
