JUSTICE SANJAY PRIYA ORAL ORDER 4/ 12-12-2017 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the Opposite Party No.2. Petitioner apprehends his arrest in Complaint Case No.69 (C) of 2016 instituted for the offence under Section(s) 420, 406, 467, 468, 471 Indian Penal Code.

Both parties have appeared and submitted that they have settled the matter outside the Court. In support of such submission, Supplementary Affidavit has been filed by the counsel for the petitioner stating therein that both parties have settled the matter for rupees ten lac and the petitioner will pay rupees seven lac within six month till May, 2018, and rest

Patna High Court Cr.Misc. No.20117 of 2017 (4) dt.12-12-2017 2/2 amount of rupees three lac will be paid till October, 2018. In such circumstances, this application is disposed off with direction to the petitioner to surrender before the Chief Judicial Magistrate, Sheikhpura, in connection with Complaint Case No.69 (C) of 2016, within a period of four weeks along with Affidavit stating terms and conditions on which matter has been settled between the parties, and the Court below on being satisfied will grant provisional bail to the petitioner for a period of nine months to its own satisfaction. The Complainant will make payment of the entire amount agreed between the parties within the period as stated above and on full and final payment of the amount, provisional bail of the petitioner will be confirmed.
