====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-06-2020 Heard learned counsel for the petitioners and the counsel appearing on behalf of the State.

Petitioners are in custody in connection with Agiaon (G) P.S. Case No. 37 of 2020 corresponding to Excise Case No. 591 of 2020 for the offence under section 30(a) of Bihar Excise and Prohibition Act.

Learned counsel for the petitioners submits that petitioners have no criminal antecedent.

In the instant case there is recovery of 727.885 liters of English wine.

Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.20408 of 2020(2) dt.19-06-2020 2/2 recovery was made from different places. The petitioners are in custody since 17.32020.

Considering the fact that petitioners have no criminal antecedent and nothing was recovered from their conscious possession, the Court is inclined to grant bail to the petitioners, let the petitioners, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge cum Special Judge, Excise, Bhojpur at Ara, in connection with Agiaon (G) P.S. Case No. 37 of 2020 subject to the condition that on release the petitioners shall render their service as volunteer in dedicated Covid-19 hospital for a period of one month. They are required to report to the district Nodal Officer who shall utilize the service of the petitioners appropriately. (Anil Kumar Upadhyay, J) Ravi/- U T
