JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-04-2017 Heard learned counsel for the petitioner and the learned counsel for the State.

This application has been filed for modification of the order dated 04.10.2016 passed in Criminal Misc. No. 38848 of 2016, whereby the petitioner was directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate Ist Class, Gopalganj, in connection with Bikunthpur P.S. Case No. 39 of 2014, subject to the condition as laid down under Section 438(2) of the Cr.P.C.

Learned counsel for the petitioner submits that due to

Patna High Court Cr.Misc. No.12753 of 2017 (2) dt.12-04-2017 unavoidable circumstances, petitioner could not surrender in the leaned court below within the stipulated time. On the grounds mentioned in the modification application, let the date of surrender be extended by four weeks from today.

The order dated 04.10.2016 passed in Criminal Misc. No. 38848 of 2016 is modified to the extent as indicated above. Accordingly, this modification application is disposed of. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
