Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 147/148/149/323/324 /325 / 326/341/342/307/302/120B of the Indian Penal Code. There is general and omnibus allegation of commission of murderous assault.

It appears that the petitioner and some other coaccused were refused bail on 13.03.2018, vide order at Annexure-1, with direction to the learned trial Judge to expedite the trial and conclude the same within a period of two years after framing of charges.

Patna High Court CR. MISC. No.31617 of 2021(2) dt.27-10-2021 2/2 Submission is that charges were framed on 18.12.2018. Petitioner is in custody since 15.08.2017. Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sessions Trial No.136 of 2018, arising out of Sono P.S. Case No. 178 of 2017, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
