Heard the learned counsel for the petitioner and the learned APP for the State.
The petitioner apprehends his arrest for the offences alleged under Section 135 of the Electricity Act, registered in connection with Fatehpur P.S.Case No. 343 of 2021/G.R.No.2583 of 2021.
As per the allegation made in the FIR, the petitioner was operating 5 HP Electric Motor by pilfering the electricity causing loss of Rs. 3,46,223/- to the Department. Learned counsel for the petitioner has submitted that
Patna High Court CR. MISC. No.22964 of 2022(6) dt.10-10-2022 2/2 the petitioner is ready to deposit 20% of the loss amount sustained by the Department in two equal monthly instalments. Considering the facts and circumstances of the case, the above-named petitioner, in the event of his arrest or surrender before court below within four weeks from the date of communication of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Electricity), Magadh Range, Gaya in connection with Fatehpur P.S.Case No. 343 of 2021/G.R.No. 2583 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C. with further condition that petitioner, at the time of furnishing bail bond, shall deposit 20% of the loss amount incurred by the Company in two equal monthly instalments. Office shall ensure that all the defects are removed by the petitioner within the stipulated time provided hereinabove, failing which the matter shall be brought to the notice of this Court.
