Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Nasriganj P.S. Case No. 07 of 2021 registered for offence punishable under Sections 379, 411, 420 and 34 of the Indian Penal Code, Section 4/40 of the Bihar Illegal Mining, Act and Section 15 of the Environment Protection Act. As per the FIR, five trucks loaded with sand were intercepted but the drivers seeing the police party fled away. Learned counsel for the petitioner has submitted that the petitioner is the owner-cum-driver of the seized truck numbered as UP 65AT-3897 loaded with sand having challan

Patna High Court CR. MISC. No.33693 of 2021(2) dt.05-04-2022 2/2 standing in the name of his younger brother Kameshwar Kumar, who works as Khalasi in that truck. In this effect photo copy of Adhar Card of Khalasi Kameshwar Kumar and Challan dated 07.01.2021 has been filed. Learned counsel for the petitioner has submitted further that the petitioner is a person of clean antecedent.

Considering the above mentioned facts and circumstances, specially the clean antecedent of the petitioner, the petitioner above named, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st Bikramganj, Rohtas in connection with Nasriganj P.S. Case No. 07 of 2021, subject to condition as laid down under Section 438 (2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
