13.01.2015 Heard learned counsel for the parties.

From the pleadings it appears that only the amount of Risk Fund payable to the petitioner remains unpaid for which as per the stand of learned counsel for the respondents, the onus lies on the petitioner as he has not filled up the requisite form. Learned counsel for the petitioner, on the other hand, submits that all forms required to be filled up have already been so done by the petitioner. However, without getting into this unnecessary controversy, learned counsel for

Patna High Court CWJC No.11783 of 2011 (5) dt.13-01-2015 2/2 the petitioner agrees that he shall once again re-submit the requisite form which may be made available to him by the concerned authority.

In view of the aforesaid, the application stands disposed off directing the authorities to send a form with regard to Risk Fund to the petitioner at the petitioner's address as mentioned in the writ application within four weeks from today. The petitioner shall thereafter return the filled up form within the next three weeks to the same authority which had sent the form to him. The authority shall thereafter make all admitted payment of the Risk Fund to the petitioner within two months thereafter.
