Petitioners are apprehending their arrest in connection with a case registered for the offence under Section 366(A)/34 of the Penal Code. They are named in the First Information Report. It is submitted on their behalf that prior to lodging of the present case on 18.06.2015 informant had filed Complaint Case No. 1538 of 2015 in the court of Chief Judicial Magistrate, Sadar, Chapra on 06.06.2015 which was also referred to the police on the same day but before any First Information Report could be registered
Patna High Court Cr.Misc. No.41517 of 2015 (2) dt.16-10-2015 on the basis of the complaint, present case was lodged and the version recorded in the complaint is little different from the version recorded in the written report filed subsequently on the basis of which present case has been registered, in appreciation of such fact petitioners deserve grant of bail in the event of arrest.
Daughter of the complainantinformant has not yet been recovered. In the circumstances, I direct the petitioners, named above, to surrender in the court below (C.J.M., Saran) within four weeks from the date of receipt/production of a copy of this order in the court below, apply for regular bail in connection with Isuapur P.S. Case No. 66 of 2015, which should be considered in accordance with law.
