The petitioner is in custody since 28.07.2016 in connection with Barauli P.S. Case No. 155 of 2016, registered for offences punishable under Sections 401, 413, 414, 411, 420, 467, 468 and 471 of the Indian Penal Code.

Allegation is of recovery of a stolen motorcycle from the possession of the petitioner.

It has been submitted on behalf of the petitioner that the only allegation that can be attributed to the petitioner is that he purchased the stolen motorcycle and there is nothing to suggest the implication of petitioner in the present case. The petitioner has no criminal antecedent and he has been languishing in judicial

Considering the aforementioned facts and circumstances, the period of custody and also that other co-accused persons have been granted the privilege of anticipatory bail vide order, dated 29.11.2016, passed in Criminal Miscellaneous No. 51022 of 2016 and vide order, dated 25.11.2016, passed in Criminal Miscellaneous No. 50883 of 2016, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Barauli P.S. Case No. 155 of 2016.
