The petitioner seeks bail in Sasaram(Model) P.S.Case No. 910 of 2018, registered under Section 414 of the Indian Penal Code.

Learned counsel for the petitioner has submitted, referring to the FIR, that two other accused persons were apprehended by the police with two motor-cycles and, according to the case of the prosecution, when the petitioner saw the police, he fled away leaving behind his motor-cycle then and there. Allegedly, other co-accused persons disclosed the petitioner's name as the man, who had fled away. The motorcycles left behind were found to be stolen ones. In this background, learned counsel for the petitioner submits that there

Patna High Court Cr.Misc. No.70496 of 2018(2) dt.04-12-2018 2/2 is no allegation that the motor-cycle was recovered from the conscious possession of the petitioner. It has also been submitted that the petitioner has no criminal antecedent. Considering the above submissions, this application is allowed. Let the petitioner above-named be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in Sasaram (Model) P.S. Case No. 910 of 2018.
