2. Learned counsel for the petitioner submits that the present writ petition has been filed with the following reliefs:-

1. That this application is being filed for issuance of an appropriate writ/writs, order/orders in the nature of on Mandamus for directing and commanding the Respondents to appoint the petitioner compassionate appointment on the ground that the father of the petitioner namely Late Ramdeo Ram died on 22/03/2018 in harness working on the post of Blue Printer in the office of

Patna High Court CWJC No.6587 of 2023(2) dt.21-07-2026 2/3 Planning Investigation & Project Preparation Division Motihari and further directing the Respondents to pay the family pension and deathcum-retiral benefits to the mother of the petitioner which has not been paid to the petitioner till date.

3. Learned counsel for the petitioner submits that the petitioner has filed representation vide Annexure-6 series of the writ petition, before the Executive Engineer on several occasion, but no decision has been taken as yet.

4. Learned counsel for the State, on the other hand, submits that there are two claimants present for the appointment. In this regard, a Letter dated 23.11.2022 vide Annexure-'I' of the counter-affidavit, has also been attached.

5. In the light of the submissions made, this Court without entering into merit or demerit of this case, hereby directs the petitioner to file a fresh representation before the Executive Engineer, Planning Investigation & Project Preparation Division, Motihari (Respondent No.4) within 30 days along with this order and Respondent No.4 shall pass a reasoned and speaking order on the same after hearing the petitioner as well as other persons, who are claiming the same relief from the Department within 90 days after receiving the same.

6. It is made clear that the said 90 days shall be
