The petitioner apprehends his arrest in connection with Chapra Town P.S. Case No. 466 of 2016 registered under Section 302 of the I.P.C. pending in the Court of C.J.M., Saran at Chapra.

Submission is that petitioner is not named in the F.I.R. He has been made accused in this case due to malice and grudge arising out of business rivalry between the families. Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of learned counsel for the petitioner with submission that in course of investigation, there is specific allegation made in several paragraphs of the case diary

Patna High Court Cr.Misc. No.11488 of 2017 (3) dt.17-05-2017 2/2 against the co-accused Nandan Kumar and this petitioner to cause the death of the deceased.

Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, prayer of the petitioner is rejected.
