JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-12-2018 Petitioner prays for bail in connection with Didarganj P.S.Case No. 76 of 2017 registered for the offences punishable under Sections 394, 364 and 34 of the Indian Penal Code. Allegation as per FIR is that some miscreants have caught hold of the driver of the truck, tied him and thereafter they fled away with the truck and petitioner is not named in the FIR and further it appears that petitioner is accused in six other cases.
Submission of learned counsel for the petitioner is that he is on bail in those cases and so far this case is concerned, except confessional statement there is nothing against him, there is no recovery from his possession and he is in custody since10.4.2018.

No.70133 of 2018(2) dt.06-12-2018 2/2 Having heard both sides and in the facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Patna City, in connection with Didarganj P.S.Case No. 76 of 2017, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
