Heard learned counsel for the petitioners as well as learned APP for the State.

The petitioners apprehend their arrest in connection with Ara Nagar P.S. Case No. 525 of 2020, registered for the offences punishable under Sections 148, 149, 147, 379, 323, 336, 427, 448, 324, 504 and 307 of the Indian Penal Code. As per allegation accused persons inflicted brick bats in the school run by the informant and dismantled the articles

Patna High Court CR. MISC. No.32808 of 2021(2) dt.04-04-2022 2/3 and vehicles belonging to the school. Thereafter, petitioner No. 1 and 2 entered into his house. Petitioner No. 1 was armed with gun. They misbehaved with the mother of the informant and snatched a golden chain from her. Petitioner No. 3, Akhilesh Kumar, assaulted the informant on his face, neck etc. by a sharp edged weapon.

Learned counsel for the petitioner has submitted that some altercation took place between both the parties since the informant was attempting to construct a pathway from his school on the land of the petitioners. He has further submitted that although the injury has been discussed in the order of learned 3rd Additional Sessions Judge, Bhojpur at Ara but it was on the basis of the medical prescription of the doctor and there was no injury report. He has also submitted that there is case and counter case and the petitioners are the persons of clean antecedent.

Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
