JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 12-10-2015 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Marouna P.S. Case No. 15/2014 registered under Sections 341, 323, 324, 302/34 of the Indian Penal Code. Regard being had to the serious nature of allegation made in the FIR in which one Laxminia Devi was killed and two others were seriously injured, I am not inclined to grant prearrest bail to the petitioners. Accordingly, the application filed under Section 438 Cr. P.C. is rejected.

In case the petitioners surrender and seek bail, the

Patna High Court Cr.Misc. No.42436 of 2015 (2) dt.12-10-2015 2 / 2 same shall be considered on its own merit without being prejudiced in any manner by this order.
