JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-01-2019 This is an application for grant of anticipatory bail in connection with Laheriasarai P.S. Case No. 362 of 2018, disclosing offences under Sections 409, 420, 467, 468, 471 and 34 of the Indian Penal Code.
Allegation as per F.I.R. is that 7 Vikas Mitra of Kiratpur Block including the petitioners have transferred the public money by illegal and forged system and also withdrawn the same.
Submission of learned counsel for the petitioners is that the the enquiry was held, which clearly shows that the petitioners have no knowledge about the illegal transfer of money and earlier one co-accused Anand Kumar Sada had transferred the money in their accounts and also withdrawn the
Patna High Court Cr.Misc. No.78018 of 2018(2) dt.04-01-2019 2/2 same.
Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with Laheriasarai P.S. Case No. 362 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
This is further subject to the condition that they will cooperate in investigation of the case and will appear as and when required, otherwise their bail bonds shall be cancelled. (Vinod Kumar Sinha, J) Amjad/- U T
