The petitioner seeks bail in Nabinagar P.S. Case No. 145/2016 registered under Sections 409/420 of the Indian Penal Code.

The petitioner is alleged to have withdrawn Rs. 9,00,000/- in the year 2012-2013 for the construction of school building and the petitioner did work of Rs. 3,45,000/- and an amount of Rs. 8,00,209/- is recoverable from the petitioner. Learned counsel for the petitioner submits that the petitioner did part work but on account of labour problem he could not complete the entire work and the petitioner is ready to return the entire outstanding amount within three months from the date of his release. The petitioner is in jail since 21.09.2016. Considering the facts that the petitioner is in jail

Patna High Court Cr.Misc. No.48807 of 2016 (2) dt.10-01-2017 2/2 since 21.09.2016 and he is ready to return the entire outstanding dues, i.e. Rs. 8,00,209/- within three months from his release, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in Nabinagar P.S. Case No. 145 of 2016.
