The petitioner is accused in connection with Bagaha (Patkhauli) P.S. Case No. 406 of 2018 registered under Section 30(A) of the Bihar Excise Act, 2016.
On receiving secret information about carrying of illicit liquor on the boat from Utter Pradesh, the informant along with other police officials reached at Narayanpur at the bank of Gandak river. On seeing the police party, 5 to 6 persons started to flee away from the boat. In that course, all succeeded to flee away. On checking the boat, which was standing at the bank of river Gandak, 155 litre kept in different bottles liquor were recovered. On quarry, informant came to know that the owner of
Patna High Court Cr.Misc. No.71434 of 2018(2) dt.06-12-2018 2/2 the said boat Raj Kumar Sahni and petitioner are indulged in the illegal business of liquor. It is further submitted that petitioner has no criminal antecedent and is in custody since 28.08.2018.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge Excise, Bettiah, West Champaran, in connection with Bagaha (Patkhauli) P.S. Case No. 406 of 2018. Out of two sureties, one surety must be the close relative of the petitioner.
