The petitioner being the mother of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 498A, 304B and 201/34 of the IPC.
The prosecution case as per the written report of Sawan Manjhi dated 4.5.2011 submitted to the SHO, Kajra Police Station is to the effect that the informant's daughter was married with Manoj Manjhi in 2009, but there was further demand of dowry of motorcycle and cash of Rupees Twenty Five Thousand and due to non-fulfillment of the same, torture was inflicted and ultimately the daughter of the informant was killed and dead body was disposed of on 30.4.2011.

No.72860 of 2018(3) dt.17-01-2019 2/2 It is submitted by learned counsel for the petitioner that the thrust of accusation is against the husband of the victim and during trial of the co-accused the informant has not alleged the accusation of torture. Moreover, other co-accused have been granted bail.
Considering the fact that the petitioner's prayer for anticipatory bail was earlier rejected vide order dated 24.4.2014 passed in Cr. Misc. No. 28144 of 2013, this Court is not inclined to interfere but keeping in view the fact that the petitioner is an old lady and other co-accused have been granted anticipatory bail, let the learned court below consider the prayer of the petitioner for regular bail in case the petitioner surrenders within six weeks in connection with Kajra P.S. Case No. 16 of 2011 pending in the Court of the learned 2nd ADJ-cum-Special Judge, Excise, Lakhisarai.
With the aforesaid observation/direction, this application is disposed of.
