22-10-2016 Heard Sri Bindhyachal Singh, learned counsel, who was assisted by Sri Ram Binod Singh, learned counsel for the petitioner and Sri Shantanu Kumar, learned Addl. Public Prosecutor.
The sole petitioner, who is in custody since 03-05-2016 in Maker P.S. Case No. 50 of 2016 registered for offence under Sections 386, 387, 399, 402, 120(B) of the Indian Penal Code, Section 25(1-b), 26, 35 of the Arms Act, 1959, Section 4 & 5 of the Explosives Substances Act, 1908 and Sections 16(1)B, 17, 18, 18(A), 19, 20, 38, 39 and 40 of Unlawful Activities (Prevention) Act, 1967, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that petitioner has falsely been implicated in the case. He was an
Patna High Court Cr.Misc. No.40876 of 2016 (4) dt.22-10-2016 2/2 employee of a company and it was alleged that petitioner had collected ransom amount and delivered to the Moist Group. He submits that petitioner has been made accused only on suspicion. Learned Addl. Public Prosecutor has opposed the prayer for bail.
Besides hearing, I have also perused the materials available on record including case diary. It is a case that on secret information, the police arrived at the place of occurrence and noticed that about 15 accused persons fleeing away, out of them, three accused persons were apprehended and thereafter, it transpired that petitioner was one of the person, who was collecting ransom money. On disclosure of the arrested accused persons, huge quantity of arms and ammunition were recovered including a pressure-cooker bomb.
In view of the seriousness of the accusation, I do not find any ground to extend the privilege of bail. Dismissed.
