Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner, who is in custody, seeks bail in a case registered for the offence punishable under Sections 147, 148, 149, 302, 307, 323, 324, 341, 448, 452 of the I.P.C. Informant has alleged in her written complaint that on 16.06.2019 at about 4:00 PM, FIR named accused persons including petitioner variously armed with deadly weapons came there and started assaulting her family members. Ganga Prasad Paswan (petitioner) assaulted her mother-in-law by means of Khanti, as a result of which she died on the spot.

Patna High Court CR. MISC. No.20378 of 2020(3) dt.12-10-2020 2/2 It has been submitted on behalf of petitioner that he is innocent and has been falsely implicated in this case due to land dispute. Petitioner has no criminal antecedent. Considering the nature of allegation against petitioner, I am not inclined to grant bail to the petitioner at this stage. Accordingly the prayer for bail is rejected.

However, petitioner may renew his prayer for bail after framing of charge.
