In the background of land dispute it has been alleged that on an order of Surendra Singh, the other accused assaulted the prosecution party and during course thereof, it has been alleged against the petitioner that he had inflicted 'Khanti' blow over informant Sudhir Kumar Singh but it had struck over head of Mahesh Thakur while he attempted to ward of the same. From Annexure-3, it is evident that Mahesh Thakur had sustained incise wound 1.5" x 1⁄4" x scalp deep over occipital region. Lacerated wound on upper part of left part of hand without having allegation of repetition of blow. Petitioner happens to be under custody since 16.09.2016 having no criminal antecedent as per para-3 of the bail petition.

No.52440 of 2016 (2) dt.19-12-2016 Accordingly, petitioner Sushil Singh @ Sushil Kumar Singh is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned ACJM, IV, Rosera in connection with Singhia P.S.
