Petitioner has challenged the order dated 6.6.2011 passed by District Fisheries Officer, Kaimur at Bhabua by which Belwatiya plot being plot no. 136 was settled.

The grievance of the petitioner is that the aforesaid pond is used by the local people for public purposes and according to notification no. 141sa2-0-1786-244 3-Ra dated 24/26 December, 1986, the aforesaid pond could not be settled. However, in course of hearing, learned counsel appearing for the petitioner seeks permission for withdrawal of this petition with liberty to file Public Interest Litigation.

With the aforesaid liberty, this writ petition stands dismissed as withdrawn.
