JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 14-02-2023 Perused the show cause filed on behalf of the Executive Engineer (respondent no. 5). He is present in person. In paragraph '5' of the show cause a statement has been made that earlier a counter affidavit was prepared on behalf of respondentExecutive Engineer, Saharsa through the then GP-23 vide Oath No. 23723 dated 07.04.2015 and for that reason he remained under impression that the same has been filed. In the nature of the explanation furnished to this Court, the show cause is accepted. No further appearance of the Executive Engineer would be required.

Heard Mr. Om Prakash Upadhyay, learned counsel for the petitioner and Mr. Madhav Prasad Yadav, learned GP-23 for the State.

The petitioner in the present case is seeking setting aside of the order dated 12.02.2004 passed by the Additional Secretary Minor Irrigation Department, Government of Bihar,

Patna High Court CWJC No.21919 of 2014(5) dt.14-02-2023 2/2 Patna in the light of an order dated 11.09.2014 passed in Civil Review No. 86 of 2014.

Learned counsel for the petitioner has after some submissions sought permission to withdraw this writ application unconditionally.

Learned GP-23 for the State has no objection to the same.
