JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 14-10-2015 Heard learned counsel for the petitioners and the State.

The petitioners apprehend their arrest in a case under Sections 363, 366A and 372 of the Indian Penal Code. Allegation is that Vikash Thakur used to keep the abducted minor girl Sita Kumari at the residence of the petitioners. Learned counsel for the petitioners submits that the victim girl in her statement under Section 164 of the Cr.P.C. stated that she has gone to the house of her mother's sister at Jamshedpur.

Having regard to the facts and circumstances of the case, in the event of arrest or surrender before the court below within four six weeks from today petitioner nos.2 and 3, namely,

Patna High Court Cr.Misc. No.43789 of 2015 (2) dt.14-10-2015 2 / 2 Jaya Devi and Puja Kumari, be released on bail on furnishing bail bond of Rs.5000/- (Five thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Munger in connection with Tarapur P.S. Case no. 11 of 2015 subject to the conditions as laid down under Section 438 (2) Cr.P.C.

The prayer for bail of petitioner no.1, namely, Suresh Thakur is disposed of with liberty to him to surrender before the court below and prays for regular bail, which would be disposed of on the same day taking into account that he has no criminal antecedent.
