The petitioner seeks bail in Excise Case No. 462 of 2018, registered under Section 30(A) of the Bihar Prohibition and Excise Act.

It is alleged that from the joint possession of the petitioner and the co-accused Ajay Kumar, the police recovered nearly 40 litres of Nepali Saufi (a kind of wine). The petitioner is in custody since 20.09.2018.

Learned counsel, appearing on behalf of the petitioner, submits that if the petitioner is again implicated in similar type of offence, the Court may consider cancellation of his bail, if allowed in the present case.

Considering the nature of accusation and the period of

Patna High Court Cr.Misc. No.70277 of 2018(2) dt.04-12-2018 2/2 custody, this application is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, East Champaran at Motihari in Excise Case No. 462 of 2018.
