The petitioner seeks bail in Noorsarai P.S.Case No.218 of 2018 registered under Sections 399, 402 of the I.P.C. and Sections 25(1-b)a, 26, 35 of the Arms Act. Informant is the police officer who in his written complaint has stated that during vehicle checking the Scorpio of the petitioner was stopped and searched and four persons were sitting in Scorpio from whose possessions arms and ammunition were recovered.
It has been submitted on behalf of learned counsel for the petitioner is that he is driver of the vehicle and the four persons were the passengers who had boarded in the way and nothing has been recovered from the possession of the petitioner. He is in custody since 23.08.2018.

No.69768 of 2018(2) dt.06-12-2018 2/2 Considering the facts and circumstances of the case, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda, Biharsharif P.S.Case No.218 of 2018 subject to the conditions that (1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by Court and their absence on two consecutive dates without sufficient reason, their bail bonds shall be cancelled by the court below and (3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
