The petitioner apprehends her arrest in Cheria Bariyarpur P.S. Case No. 13/2016, registered for the offence punishable under Section 420 of the Indian Penal Code.

The informant, wife of Krishna Nandan Singh, alleged that late Shaligram Singh, own brother of her husband and his son did not want to give share to her as her husband was mentally retarded. She further alleged that son of late Shaligram Singh, namely, Anjani Kumar Singh @ Pappu and Arun Singh filed a suit making the petitioner as defendant. Arun Singh and Anjani Kumar Singh by compromising the case with the petitioner obtained a decree and stated in the plaint that their late father Shaligram Singh was sole legal heir of their grandfather.

Patna High Court Cr.Misc. No.11179 of 2017 (2) dt.27-03-2017 2/2 Learned counsel for the petitioner submitted that the petitioner has no manner of concern. The land was standing in the name of the petitioner, but she does not know as to who was the owner of the land.

On the other hand learned Additional P.P.

vehemently opposed prayer for anticipatory bail. Considering the facts aforesaid and the fact that the petitioner is lady and the land standing in the name of mother-in-law of the petitioner who is also Laxmi Devi, the land of Shaligram Singh and his father was standing in the name of Laxmi Devi and the petitioner disowned the property stating that the property is Benamdar, the petitioner above named in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Manjhaul, Begusarai in connection with Cheria Bariyarpur P.S. Case No. 13/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi U T
