JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 14-09-2020 Heard Mr. Sanjeet Kumar, learned counsel appearing on behalf of the petitioner and Mr. Rakesh Kumar Singh, learned counsel appearing on behalf of the Bank.

Patna High Court CWJC No.7089 of 2020(3) dt.14-09-2020 2/3 Counsel for the petitioner admits that certain excess amount has been paid to the petitioner and the Bank is justified in recovering the excess amount. He informs the Court that the Bank has decided to fix instalments for recovery of the excess amount paid but instead of recovering the excess amount in instalment, they have kept the Account of the petitioner on hold.

Considering the aforesaid, the writ petition is disposed of with a direction to the Bank to release the Bank account of the petitioner from hold and start deducting instalments fixed by the Bank and ensure payment of balance amount of pension to the petitioner so that the petitioner may survive by receiving remaining amount of pension after deduction of instalment amount fixed for recovery of excess payment made to the petitioner. The entire exercise including payment to the petitioner in terms of their own decision of recovery of excess amount in instalment, must be completed within a period of one month from the date of receipt/production of a copy of this order so that the balance amount is paid to the petitioner after deducting the instalment so fixed for recovery of the excess amount.
