JUSTICE SUDHIR SINGH ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 467, 468, 471, 420, 414/34 of the Indian Penal Code. Allegation against petitioner is that police party arrested him with a stolen motorcycle.
It has been submitted on behalf of petitioner that he has got no criminal antecedent. He is in custody since 10.8.2016. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. Petitioner has falsely been implicated in the present case. The recovered motorcycle is not a stolen property. There is no case of theft instituted in respect to the recovered motorcycle. The said motorcycle was taken by petitioner from his friend, namely, Pintu Bhagat, who runs a garage.
On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond
Patna High Court Cr.Misc. No.50506 of 2016 (2) dt.24-11-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Siwaipatti P.S. Case no. 71 of 2016.
