JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 07-06-2017 Heard learned counsel for the petitioners and learned counsel for the State.

Petitioners are appending their arrest in connection with Teghra P.S. Case No. 275 of 2016 registered for offences under sections 341, 323, 447, 302/34 of the Indian Penal Code. Petitioners and one Rajo Das are main accused. As per the F.I.R., allegation is that petitioners and Rajo Das during the altercation assaulted the informant and pushed his wife, who fell down and died on way to the hospital.

Co-accused Rajo Das was granted anticipatory bail by a co-ordinate Bench of this Court in Cr. Misc. No. 19277 of 2017 on 09.05.2017.

Having regard to the parity of allegation, I am

Patna High Court Cr.Misc. No.20377 of 2017 (2) dt.07-06-2017 2/2 inclined to grant the privilege of anticipatory bail to the petitioners. Let the petitioners, above named, in the event of arrest or surrender before the court below within a period of four weeks from today, be released on bail on their furnishing bail bond of Rs.25,000/-each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur/Successor Court in connection with Teghra P.S. Case No. 275 of 2016, subject to the condition as laid down under section 438 (2) of the Criminal Procedure Code.
