2. The petitioners apprehend their arrest in connection with Kesariya P.S. Case No. 425 of 2025, instituted for the offences under Sections 126(2), 115(2), 318(1), 303(2), 109, 352, 351(2), 3(5) of the B.N.S.

3. As per the prosecution case, on the date of occurrence F.I.R. named accused persons including the petitioners armed with farsa, Bhala and iron rod came at the house of the informant and started abusing him due to land dispute. On protest, all the accused persons started assaulting the informant and his family members. They tried to outrage the modesty of mother of informant. The accused persons also snatched gold ornament from Panwa Devi and they took out cash of Rs. 10,000/- from the pocket of Pramukh Rai.

4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case due to dispute relating to pathway. Injuries on the injured are simple in nature. Petitioners and informant are neighbours. There is delay of 28 days in lodging the F.I.R. Petitioners have one criminal antecedent in which they are on bail. Petitioners undertake to co-operate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

6. Considering the facts and circumstances of the case, submission of learned counsel for the parties and nature of injury, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail

No.23191 of 2026(4) dt.14-05-2026 3/3 upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Kesariya P.S. Case No. 425 of 2025, subject to the conditions laid down in Section 482 (2) of the Bharatiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023.
