JUSTICE ARVIND SRIVASTAVA ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is an accused in Tr.No.834/16 arising out of Complaint Case No.2028/14 registered under Sections 498(A), 323, 504 and 406 of the Indian Penal Code. The allegation against the petitioner is of demand of dowry from the complainant's parents as well as torturing the complainant mentally and physically by the petitioner and his family members.

The submission of the petitioner is that when he had gone to foreign for his livelihood his wife (complainant) eloped
