JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-06-2017 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in connection with Runnisaidpur P.S.Case No. 628 of 2015 for the offences under Sections 354, 506, 341/34 of the Indian Penal Code.
F.I.R. was registered on 14.12.2015 for the alleged offence dated 28.11.2015. It appears that the allegation against the petitioners is that they along with others tried to abduct the informant. The petitioners have stated that the present case is counter blast of Sitamarhi P.S.Case No. 619 of 2015, which was registered at the instance of co-accused. My attention has been drawn to an order passed by this Court in Cr. Misc.No. 18447 of
Patna High Court Cr.Misc. No.20235 of 2017 (2) dt.05-06-2017 2/2 2016 (Annexure 4) whereby this Court vide order dated 29.04.2016 has been pleased to grant anticipatory bail to coaccused, Sonam Kumar @ Soman Kumar. The petitioner has stated in para 3 of the petition that he has no criminal antecedent. On the ground of parity, I am inclined to grant anticipatory bail to the petitioner. Let the above named petitioners, in the event of their arrest/surrender in the court below within a period of four weeks from the date of receipt/ production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/( ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in Runnisaidpur P.S.Case No. 628 of 2015,subject to the conditions as laid down u/s 438(2) Cr.P.C.
