Petitioner seeks bail in a case registered for the offences punishable under Section 395 of the Indian Penal Code.
The FIR of the occurrence of dacoity is against unknown.
Submission is that the petitioner is in custody since 24.01.2019. Investigation of the case is already complete. Petitioner was never put on T.I.Parade nor anything incriminating was recovered from his possession. Only material is confessional statement of co-accused before the police, who has already been allowed bail.
Learned counsel for the State has opposed the
Patna High Court CR. MISC. No.25506 of 2019(3) dt.11-06-2019 2/2 prayer for bail for the reason that petitioner has got criminal antecedent.
Considering the entire facts especially the fact that there is no substantial material against the petitioner for refusal of prayer for bail, hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Goh Police Station Case No.63 of 2017, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
