JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-08-2017 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners are apprehending their arrest in Baikunthpur P.S.Case No. 83 of 2016 instituted for offences punishable under Sections 304 (B)/34 of the Indian Penal Code. The accusation is of torturing and killing the sister of the informant by setting her on fire by her in-laws family. Learned counsel appearing on behalf of the petitioners submits that in fact the petitioners are brother-in-law, mother-in-law, Gotni and father-in-law of the deceased and in fact, sister of the informant set fire as a result of which, she died.

No.17893 of 2017 (3) dt.11-08-2017 2/2 Learned counsel appearing on behalf of the petitioners submits that the deceased died by burn injuries as during the course of cooking and thereafter, she was immediately admitted for treatment in Government Primary Health Centre, Baikunthpur ( Gopalganj) and she was further referred to Gorakhpur Medical College for better treatment, where she died in course of the treatment after one day after occurrence.

Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- ( Ten thousand)each with two sureties of the like amount each in connection with Baikunthpur P.S.Case No. 83 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, subject to the condition laid down under Section 438

(2) of the Criminal Procedure Code.
