The petitioner seeks regular bail in connection with Tajpur P.S. Case No. 301 of 2018 for the offences punishable under Sections 272, 273 of the Indian Penal Code and 30(a) of Bihar Prohibition and Excise Act, 2016.
The allegation is regarding recovery of 4.500 liters of illicit liquor from the side of Kali Pokhar temple situated at Bharokhara and the persons present there stated that the said illicit liquor belongs to the petitioner and other co-accused persons.
The learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in the present case after he was arrested in connection with Tajpur
Patna High Court Cr.Misc. No.70513 of 2018(2) dt.12-12-2018 2/2 P.S. Case No. 294 of 2018 and thereafter he was remanded in the present case. It is further submitted that the petitioner is languishing in custody since 24.9.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/0 with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-6th cum Special Judge, Excise Act, Samastipur, District Samastipur in connection with Tajpur P.S. Case No. 301 of 2018.
