JUSTICE BIBEK CHAUDHURI ORAL ORDER 05-07-2024 The petitioner was appointed on contractual basis by an order dated 15th May 2017 in the office of the Senior District Commandant, Bihar Home Defense Corps, District - Munger from the list of selected candidates maintained by the District Magistrate, Munger to offer contractual engagement to the candidates whenever there is any requirement of any such department under the control of the District Magistrate.

2. However, the petitioner was not found suitable and he was released on 26th December 2017 in favor of the District Magistrate on the ground that he was not suitable to work in the office of the Senior District Commandant, Bihar Home Defense

Patna High Court CWJC No.5991 of 2024(2) dt.05-07-2024 2/2 Corps, District - Munger. That on 27.02.2024, the petitioner filed an application praying, inter alia, to appoint him to any other department in the District of Munger where service of contractual employee is needed. The said representation has not been considered till date by the District Magistrate, hence, the instant writ petition is being filed.

3. The learned Advocate for the State submits that the instant writ petition may be disposed of directing the District Magistrate to dispose of the representation in accordance law.

4. In view of such submission, the instant writ petition is disposed of directing the concerned District Magistrate to consider the representation submitted by the petitioner on 21.02.2024 within two months from the date of communication of this order and to inform the petitioner about the result of such representation.
