The State of Bihar .... .... Opposite Party ====================================================== CORAM: HONOURABLE MR. JUSTICE RAMESH KUMAR DATTA ORAL ORDER 14-12-2015 Heard learned counsel for the petitioners in both the cases and learned Additional P.P. for the State.
The petitioners pray for anticipatory bail in a case under Sections 147, 148, 149, 324, 325, 326, 307, 436, 380, 427, 302, 153A, 295A and 363 of the Indian Penal Code.
It is submitted by learned counsel for the petitioners that the FIR was lodged against 13 named accused persons and as
Patna High Court Cr.Misc. No.42304 of 2015 (3) dt.14-12-2015 many as 1000 unknown persons and the petitioners' names have been dragged into the present matter subsequently. It is further submitted that as many as 14 named accused persons have been granted bail by this Court in Cr.Misc. Nos. 14052, 19957, 23701, 25122, 26246, 34213 and 43165, all of 2015.
On a consideration of the facts and circumstances of the case, it is directed that the petitioners, namely, (1) Kamal Sahani,
(2) Santosh Sahani, (3) Vikki Kumar, (4) Jhuri Sahani @ Jhori Sahani, (5) Rajesh Sahani and (6) Raghunath Sahani, in the event of their arrest/surrender in the court below within a period of four weeks from today, shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each in connection with Saraiya P.S.Case No. 20 of 2015 (Sessions Trial No. 232 of 2015) to the satisfaction of Additional Sessions Judge, XIth, Muzaffarpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
