JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-04-2019 The petitioner seeks bail in connection with Sherghati P.S.Case No. 27 of 2012 registered under Sections 304B/34 of the Indian penal Code and 3 and 4 of the Dowry Prohibition Act.
Earlier prayer for bail of the petitioner was rejected vide order dated 12.09.2018 passed in Cr. Misc. No. 41513 of 2018. Petitioner happens to be the husband and there is allegation of causing death of his wife for demand of dowry. Submission of learned counsel for the petitioner is that petitioner is in custody for more than one year and up-till-now case has not been committed to the court of sessions. Heard learned APP also.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant
Patna High Court CR. MISC. No.21233 of 2019(2) dt.04-04-2019 2/2 privilege of bail to the petitioner.
However, trial court is directed to expedite the commitment so that commitment be made within a period of three months. Learned Sessions Judge, Gaya will also ensure that commitment of the case be made within a period of three months.
