JUSTICE MUNGESHWAR SAHOO ORAL ORDER 18-05-2016 Perused the order dated 21.05.2015 passed by Munsif, Katihar in Title Suit No.15 of 2012. The Court below after considering the materials available on record clearly recorded a finding that there is no interest of the interveners-petitioners in the property which is the subject matter of the title suit and, therefore, according to the Court below, the interveners are not necessary party.

Thus, the order passed by the Court below is pure finding of fact. For the purpose of supervising the order, this Court cannot substitute its own finding even if the other view is possible on the basis of the materials. Therefore, I find no reason to interfere with the impugned order.

Accordingly, this writ application is dismissed. (Mungeshwar Sahoo, J) Saurabh/- U T
