The petitioner seeks bail in Excise Case No.846 of 2018 registered under Sections 30(A) of the Bihar Prohibition and Excise Act.

Accusation is of recovery of 13 bottles each containing 180 ml, two bottles each containing 375 ml. and one bottle containing 100 ml. Indian made foreign liquor from the possession of the petitioner.

Learned Counsel for the petitioner submits that, in fact, petitioner was accused in earlier Kudra P.S. Case No.200 of 2017 of similar nature in which he is on bail. As such, he has been falsely implicated in this case by the police who is in custody since 24.09.2018 having no criminal antecedent.

Patna High Court Cr.Misc. No.71253 of 2018(2) dt.03-12-2018 2/2 Learned A.P.P. opposed the prayer for bail of the petitioner.

Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Special Judge (Excise), Kaimur at Bhabua, in Excise Case No.846 of 2018 arising out of Kudra P.S.Case No.414/18.
