The petitioner seeks bail in a case instituted under Sections 457 and 380 of the Indian Penal Code. The prosecution story in brief, is that a theft is said to have been made in the shop of the informant by unknown thieves and they have taken away sari and cash of Rs. 3 lac. It has been submitted on behalf of the petitioner that the petitioner is in custody since 05.09.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. He has been made accused only on the basis
Patna High Court Cr.Misc. No.51093 of 2016 (2) dt.28-11-2016 2/2 of confessional statement of co-accused. No any incriminating article is said to have been recovered from the possession of the petitioner. He has not been put on Test Identification Parade. On behalf of the state, it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Madhepura in connection with Murliganj P.S.
