JUSTICE SANJAY PRIYA ORAL ORDER 27-02-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Falka (Pothia) P.S. Case No. 137 of 2016 instituted for the offence under Sections 363 and 366(A) of the Indian Penal Code. It has been submitted that in paragraph-25 of the case diary the police has mentioned about CDR wherein it has been mentioned that there was several talks between the petitioner and victim girl.

Learned A.P.P. has submitted that the victim in her statement under Section 164 Cr. P.C. has made specific allegation against the petitioner.

From perusal of the statement of the victim girl under Section 164 Cr. P.C. it appears that she has leveled specific

Patna High Court Cr.Misc. No.3133 of 2017 (3) dt.27-02-2017 2/2 allegation against the petitioner of kidnapping and forcing her to call through mobile to her mother and make demand of Rs.5,00,000/- and also assaulted her. She anyhow managed to escape. The informant has leveled specific allegation against the petitioner of committing torture.

Considering the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner.

The prayer for anticipatory bail of the petitioner stands rejected.

The petitioner is directed to surrender before the court below and pray for regular bail which shall be disposed off by the court below on the same day on its own merits without being prejudiced by this order.
