The petitioner seeks regular bail in connection with Ahiyapur P.S. Case No. 1360 of 2018 for the offences punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-b)1, 26, 35 of Arms Act.

The allegation is regarding the police having received secret information to the effect that some miscreants had assembled at the Bus stand and were planning to commit some crime, whereafter the police had raided the said place and arrested the accused persons including the petitioner herein and upon search, two pistols along with two live cartridges were recovered from the possession of the petitioner. The learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.19935 of 2019(2) dt.05-04-2019 2/2 petitioner is innocent and has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 24.12.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to direct for release of the petitioner immediately upon completion of six months of his custody i.e. w.e.f. 24.12.2018 subject to such condition as may be imposed by the learned court of Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 1360 of 2018.
