JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 25-02- Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are apprehending their arrest in a case registered in connection with Gopalganj P.S.Case No. 162 of 2019 for the offences punishable under Sections 341, 323, 324, 307, 504, 506 and 34 of the Indian Penal Code. As per prosecution, a scuffle took place between the informant and the petitioner due to filthy song sung by the DJ on his lands. When the informant and his family members protested, the accused petitioners started abusing and assaulted the informant side.

Learned counsel for the petitioners submits that there

Patna High Court CR. MISC. No.32462 of 2021(3) dt.25-02-2022 2/2 is a case and counter case between the informant and the petitioners. After perusal of the F.I.R Rakesh Sah assaulted to the wife of informant by sword on her head and Manoj Sah assaulted Anup Sah by iron rod on his head caused by hard and blunt substance which is simple in nature.

Learned Additional Public Prosecutor opposes the bail prayer of the petitioner.

Considering the facts and circumstance of the case as well as submission of the parties, let the petitioners in the event oftheir arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj P.S Case No. 162 of 2019 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
