The petitioner seeks regular bail in connection with Mohania P.S. Case No. 260 of 2015, registered for the offence punishable under Section 394 of the Indian Penal Code.

The allegation is regarding unknown accused persons having apprehended the informant while he was returning to his house on his motorcycle whereafter, the said unknown accused persons had taken away the motorcycle of the informant.

The learned counsel for the petitioner submits that the petitioner is having a clean antecedent, no recovery has been made from his possession and no Test Identification

Patna High Court Cr.Misc. No.72332 of 2018(2) dt.12-12-2018 2/2 Parade has been conducted so as to connect the petitioner with the alleged crime. The petitioner is stated to be languishing in custody since 29.08.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Mohania P.S. Case No. 260 of 2015.
