The petitioner apprehends his arrest in Samastipur (Town) P.S. Case No. 245/2015, registered for the offences punishable under Sections 406, 420 and other sections of the Indian Penal Code.
The informant alleged that the petitioner Rajesh Raushan introduced him to some persons and disclosed that they were owner of the land situated in the town. They were initiated to sell the land. The informant gave Rs. 48,00,000/- on different dates to Rajesh Raushan (petitioner) who handed over same to the land owner, the deed was executed and presented to the Registrar, but thereafter the so-called land owner fled away without accepting the execution of deed of sale.
Patna High Court Cr.Misc. No.10918 of 2017 (2) dt.28-03-2017 2/2 Learned counsel for the petitioner submits that other accused persons who are the so-called land owners have already been enlarged on anticipatory bail by the learned Sessions Judge, Samastipur. The case of the petitioner stands on better footing. The petitioner had no knowledge that other accused persons are not the land owner and they received money from the informant. The case has been compromised and compromise petition is filed (at annexure-3).
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Samastipur in connection with Samastipur (Town) P.S. Case No. 245/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
